INKYSPA LLC WAVIER RELEASE CONSENT, POLICIES TERMS & CONDITIONS
Wavier & Release Terms & Agreements:
InkySPA Terms and Agreements, I understand that a 50% Non-Refundable Deposit is Required to hold and book an appointment and is due at the time of booking, on the day you make the appointment. I understand All Deposits and Payments are NON-REFUNDABLE, NO EXCEPTIONS! If deposit is not received by end of day your appointment date will be cancelled or forfeited and you will have to rebook. I do not hold appointments it is first come first serve. I acknowledge that I have read all of the terms and agreements for InkySPA. I agree to contact my artist if need to make different arrangements.
Deposit Policy:
ALL DEPOSITS ARE NON-REFUNDABLE! A deposit guarantees your appointment and assures your commitment. Deposits will be applied towards the final cost of your tattoo, wax or facial appointment unless your deposit is forfeited. Deposits are forfeited if you no-show for an appointment, cancel with less than 24 hours advance notice, reschedule more than twice, arrive for an appointment more than 15 minutes late without notice, arrive for an appointment without proper ID or arrive intoxicated or otherwise unable to be tattooed, waxed or serviced, request excessive or last minute changes to the design or concept, do not complete your tattoo within two years, or decide not to get tattooed at all. If you forfeit a deposit, you may be required to leave a new deposit before booking any new appointments. Deposits may not be transferred to another person or for use with a different tattoo artist or esthetician.
Cancellation Policy:
All appointments require a minimum of 24 hours notice for cancellation. If cancelled within 24 hours notice, your deposit may be applied to a future appointment. If an artist has to reschedule due to an unexpected emergency *family, sick etc you will be contacted and your deposit will be applied to a future appointment. You have at least 30 days from the original appointment date to reschedule your tattoo, wax or facial appointment. Failure to communicate to reschedule your appointment in a timely manner will forfeit your deposit. DEPOSITS ARE NON-REFUNDABLE.

Reschedule Policy:
All appointments require at least 24 hours notice to reschedule. If at least 24 hours notice is given, your deposit may be applied to your new appointment. If an appointment is rescheduled more than twice, your deposit will be forfeited.
Late Policy:
Please let me know if you are running late for an appointment. If you are 15 minutes or more late for an appointment without advance notice, you may forfeit your deposit, lose your appointment and be required to reschedule and leave a new deposit.
Artwork Policy:
I will not email, text, or preview a custom design for your review until your scheduled appointment. Any revisions that stay within the idea discussed at the consultation can be made on the day of your appointment. If you change your idea, placement, concept, etc and major or excessive revisions are required, your deposit will be forfeited and your appointment will need to be rescheduled and a new deposit may be required.
Custom Tattoo Policy:
Out of respect for the original artist and collector, I will not copy or duplicate any custom tattoo or tattoo design. This applies to tattoos we have created custom for our clients as well as tattoos found online or elsewhere that someone else has created. If you fall in love with a tattoo that an artist has done, please ask the artist to create something similar or inspired by that tattoo for you. Remember we can (and prefer to) customize it specifically to you and for your body. PLEASE NOTE: Flash tattoos are meant to be duplicated and can be tattooed many times, with or without customization.
18 years +
The legal age to get a tattoo in the state of Illinois is 18. Anyone younger than 18 cannot be tattooed even with a parent or legal guardian's signature.
Touch Up Policy:
Courtesy touch ups are at the discretion of the tattoo artist. Necessary touch ups related to the technical application and healing of a tattoo are free if done within 6 months of the tattoo and by the original artist who did the tattoo (unless the tattoo is on a non-guaranteed body part, see below). Touch ups cannot be done until the tattoo is fully healed. Touch ups due to client failure or negligence to follow our aftercare procedures are not free and will be charged the same rate as a new tattoo. Changes to the original agreed upon tattoo are not considered a touch up and will be charged as a new tattoo. HEALING RESULTS OF TATTOOS ON THE HEAD, FACE, GENITALS, FEET, OR HANDS (INCLUDING FINGERS) CANNOT BE GUARANTEED AND MAY NOT BE ELIGLE FOR FREE TOUCH UPS. If your tattoo is on a non-guaranteed body part it will probably need multiple touch ups and may be charged as a new tattoo each time.
Refund Policy:
NO REFUNDS for any reason. In the unlikely event of a mistake it is the duty of the artist to fix it for free. There is always something we can do. Please contact the studio as soon as possible to allow us to find the best & quickest solution.
Guest Policy:
You may bring only one guest with you to accompany you while you get tattooed. Your guest must be over the age of 18. Out of respect for the other clients getting tattooed who need to relax as well as the artists who need to focus on their tattooing work, any excess guests or disruptive guests will be asked to leave. Children or minors are not permitted in the tattooing area at any time. Be aware that tattoo shops are intended for adults only and even an accompanied minor in the lobby area may see some nudity or hear adult language.
INFORMED CONSENT TO RECIEVE SERVICES
I understand I am here to receive a Tattoo Service from Tattoo Artist Katisha Farrell at InkySPA LLC. I acknowledge the following by checking each box below:
I understand that InkySPA LLC has a zero tolerance drug & alcohol policy. I am not under the influence of any drugs or alcohol. I am of sober mind & voluntarily submit myself to receive tattoo. If any client moves excessively, causes loud noise, disrespectful, disruptive behavior during procedure you will be asked to leave InkySPA LLC can stop and refuse service at any time for any reason. NO REFUNDS for any services provided.(Required)
I am not under duress or coercion. I willfully submit myself to receive tattoo.(Required)
I understand there is a risk of hyperpigmentation when receiving a tattoo. I understand this is rare but if occurs I understand there is no way to tell who skin will react this way. I agree this is not intentionally caused by my tattoo artist therefore understanding they are not legally liable.(Required)
I agree to protect my tattoo in the sun with sunscreen, depending on area of the tattoo. I understand if I expose my tattoo to sun or tanning booth, it may fade or cause discoloration of tattoo.(Required)
I understand there is a risk I may feel dizzy, lightheaded or tired during the procedure. I agree to notify my technician immediately if this occurs(Required)
I understand tattoos are permanent and may only be laser removed or cover up.(Required)
I agree to inform my tattoo artist of any changes to tattoo before the procedure begins. I acknowledge before the tattoo procedure starts, I have agreed to the shape, location, design and color of tattoo therefore, giving my tattoo artist permission to start the procedure.(Required)
Katisha Farrell (InkySPA LLC) is not responsible for the meaning or spelling of the symbol or text that I have provide to them or chosen from the flash (design) sheets. Variations in color and design may exist between the tattoo art I have selected and the actual tattoo when it is applied to my body. I also understand that over time, the colors and the clarity of my tattoo will fade due to unprotected exposure to the sun and the naturally occurring dispersion of pigment under the skin.(Required)
I understand that the quality of work can differ based off of quality, age, texture of skin, experience of technician & how well I take care of my tattoo.(Required)
The signs of infection are as follows (but not limited to): Redness, abnormal swelling, warm to touch, discharge or extreme scabbing. I understand there is a possibility of infection if I fail to follow proper aftercare instructions. I agree to seek proper medical attention if a infection occurs.(Required)
I understand there is a risk of an allergic reaction. Signs & Symptoms of a reaction are (but not limited to): red, bumpy, itchy skin. If this occurs, I agree to seek proper medical care.(Required)

I release the right to any photographs and or videos taken of me and the tattoo and give consent in advance to their reproduction in print or electronic form social media etc. (If you don't want any pics taken please let the artist know before the procedure starts.)(Required)
I agree that Katisha Farrell (InkySPA LLC) has a NO REFUND Policy on All Services Tattoos, Waxing, Facials and-or retail sales and I will not ask for a refund for any reason whatsoever.(Required)
I agree to reimburse Katisha Farrell (InkySPA LLC) for any attorneys' fees and costs incurred in any legal action I bring against Katisha Farrell (InkySPA LLC.) and in which Katisha Farrell (InkySPA LLC) is the prevailing party. I agree that the courts of Chicago, IL Cook County shall have personal jurisdiction and venue over me and shall have exclusive jurisdiction for the purposes of litigating any dispute arising out of or related to this agreement.(Required)
I WAIVE AND RELEASE to the fullest extent permitted by law Katisha Farrell (InkySPA LLC) from all liability whatsoever, for any and all claims or causes of action that I, my estate, heirs, executors or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the procedure and application of my tattoo, whether caused by the negligence or fault of Katisha Farrell (InkySPA LLC.)(Required)
I Release Tattoo Artist Katisha Farrell and InkySPA LLC from any legal liabilities from the prior releases I checked above. Tattoo Artist nor establishment is responsible for any infection caused from my lack of proper disclosure, aftercare, hyperpigmentation, allergic reaction, medical issues that may arise from falsified information I provided on this form.(Required)
